These Terms of Service (“Terms”) apply to your use of the Made In Australia website and marketplace located at https://www.madeinaustralia.com.au (“Platform”).
By accessing or using the Platform, you agree to these Terms.
1. About Made In Australia
Made In Australia operates a curated online marketplace that connects customers with independent Australian-based sellers offering Australian-made products.
Unless stated otherwise, Made In Australia does not manufacture, store or ship products.
2. Marketplace role
Made In Australia acts as a marketplace and technology platform only.
Each product is sold by a third-party seller (“Seller”) and fulfilled directly by that Seller.
A contract for the sale of products is formed between you and the relevant Seller.
3. Eligibility
You must be at least 18 years of age and capable of entering a legally binding agreement to use the Platform.
4. Accounts
You are responsible for maintaining the confidentiality of your account details and for all activity that occurs under your account.
5. Product listings and information
Sellers are responsible for:
- the accuracy of product descriptions, images and claims
- pricing and availability
- compliance with all applicable laws
While we curate and verify sellers, we do not guarantee that all product information is complete, current or error-free.
6. Orders and payments
When you place an order:
- you are purchasing directly from the Seller
- payment is processed through our payment providers on behalf of the Seller
- the Seller is responsible for supplying the product and meeting delivery obligations
We reserve the right to refuse or cancel orders where required to protect the integrity of the Platform.
7. Shipping and delivery
Shipping, dispatch times and delivery methods are set by each Seller.
Estimated delivery times are provided by Sellers and are not guaranteed.
8. Returns, refunds and consumer rights
Each Seller maintains their own returns and refund policy, which is displayed on the relevant product or seller page.
Your rights under the Australian Consumer Law cannot be excluded and apply in addition to any Seller policy.
Refunds and replacements are the responsibility of the Seller, except where required by law.
9. Communication with Sellers
You may contact Sellers through the tools provided on the Platform.
Sellers may use your information only for:
- fulfilling your order
- customer service relating to that order
- legal or operational requirements connected with the transaction
10. Verification and “Australian-made” claims
Made In Australia operates a manual verification process for Sellers and products.
However, you acknowledge that:
- verification is based on information provided by Sellers
- Made In Australia does not independently audit manufacturing facilities
- we do not warrant that every product is made entirely in Australia unless expressly stated
If you believe a product listing is misleading, please contact us.
11. Prohibited conduct
You must not:
- use the Platform for unlawful purposes
- interfere with the operation or security of the Platform
- attempt to gain unauthorised access to systems or data
- misuse Seller or customer information
12. Intellectual property
All content on the Platform (excluding Seller content) is owned by or licensed to Made In Australia.
Sellers retain ownership of their own brand names, logos, images and product content.
You may not reproduce or use any content without permission.
13. Platform availability
We do not guarantee that the Platform will be available at all times.
We may suspend or restrict access for maintenance, security or operational reasons.
14. Limitation of liability
To the maximum extent permitted by law:
Made In Australia is not liable for any loss or damage arising from products supplied by Sellers
Made In Australia is not responsible for delivery delays, product defects, or Seller conduct
Nothing in these Terms limits any rights you have under Australian Consumer Law.
15. Indemnity
You agree to indemnify Made In Australia against any claims, losses or liabilities arising from your misuse of the Platform or breach of these Terms.
16. Termination
We may suspend or terminate your access to the Platform if you breach these Terms or misuse the Platform.
17. Changes to these Terms
We may update these Terms from time to time.
The current version will be published on our website and applies from the date shown above.
18. Governing law
These Terms are governed by the laws of Queensland, Australia.
